Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and FreeWeight ("we," "us," or "our"), governing your use of the FreeWeight mobile app and this website (together, the "Services"). Please read them carefully. They include an assumption of risk, a release and waiver, and limits on our liability.
By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use FreeWeight. By using the Services, you represent that you are 18 or older and able to enter into this agreement.
2. License to use
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial fitness use, subject to these Terms.
3. FreeWeight is not medical advice
FreeWeight provides general fitness and exercise ideas that use everyday household objects as equipment. The Services are for general informational and fitness purposes only. They are not medical advice, diagnosis, treatment, or supervised training, and they are not a substitute for advice from a physician or a qualified fitness professional. Weight estimates and exercise suggestions are approximate and general and may not be appropriate for you. Consult a physician before beginning any exercise program, particularly if you have a medical condition or injury, are pregnant or recently gave birth, take medication, or are unsure whether exercise is safe for you. If you feel pain, dizziness, chest discomfort, shortness of breath, or any concerning symptom, stop and seek medical attention.
4. Assumption of risk
You understand that physical exercise carries inherent risks, including the risk of serious injury, disability, or in rare cases death. Using ordinary household items as exercise equipment adds further risks: items and containers can break, leak, slip, shift, or fail; furniture, doors, and surfaces may not be stable or rated to hold weight; and weight estimates may be inaccurate. You are solely responsible for choosing appropriate exercises and loads, for confirming that any item, furniture, or surface you use is safe, stable, and rated for the intended weight, for using proper form, and for stopping when needed. You knowingly and voluntarily assume all risks associated with your use of the Services and the activities they suggest, whether those risks are known or unknown.
The FreeWeight scanner uses an automated model to identify objects and estimate their weight. Any identification or weight it returns is an approximation only, is generated automatically, and may be incomplete or wrong. It is a starting point, not a measurement. You are responsible for reviewing and adjusting any estimate, and for checking an object's true weight, grip, and stability, before you use it. Do not rely on a scan result as an accurate or safe weight.
5. Release and waiver
To the fullest extent permitted by law, you release, waive, and discharge FreeWeight and its owners, employees, contractors, and partners (the "FreeWeight Parties") from any and all claims, demands, liabilities, and causes of action of any kind arising out of or relating to your use of the Services or any exercise, item suggestion, or activity, including claims for personal injury, property damage, or loss, whether based on negligence or any other theory, to the maximum extent the law allows.
6. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or secure, or that any result, weight estimate, or recommendation will be accurate or suitable for you. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
7. Limitation of liability
To the fullest extent permitted by law, the FreeWeight Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to the Services, even if advised of the possibility. To the fullest extent permitted by law, the total liability of the FreeWeight Parties for all claims relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or twenty US dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless the FreeWeight Parties from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
9. Subscriptions, trials, and billing
FreeWeight may offer a paid subscription ("Pro"), which may include a free trial. Purchases, free trials, renewals, and cancellations are processed by the app store on your device (Apple App Store or Google Play) under their terms, not by us directly.
- Auto-renewal: subscriptions renew automatically at the price and interval shown at purchase, unless you cancel at least 24 hours before the end of the current period.
- Free trial: if you do not cancel before the trial ends, it converts to a paid subscription.
- Manage or cancel: you can manage or cancel anytime in your app store account settings. Deleting the app does not cancel a subscription.
- Refunds: refunds are handled by the app store under its policies.
- Price changes: we may change prices going forward; changes apply to future billing periods and, where required, only with your consent.
10. Acceptable use
You agree not to misuse the Services, including by trying to access them in an unauthorized way, interfering with their operation, reverse engineering or copying them except as the law allows, or using them for any unlawful purpose.
11. Intellectual property
The Services, including their software, content, design, and trademarks, are owned by FreeWeight or its licensors and are protected by law. Except for the license granted to you, we reserve all rights. You may not use our name or marks without permission.
12. Third-party services
The Services rely on third parties, including the app stores and our vision provider. Your use of those services is subject to their terms, and we are not responsible for them.
13. Feedback
If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use them without any obligation to you.
14. Termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or to protect the Services. Sections that by their nature should survive termination will survive, including the disclaimers, the release, the limitation of liability, and indemnification.
15. Changes
We may modify the Services or these Terms. If we make material changes to these Terms, we will update the effective date above and, where required, notify you. Continued use after a change means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Any dispute relating to the Services that is not resolved informally will be handled by the state or federal courts located in California, and you agree to that jurisdiction.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms are the entire agreement between you and FreeWeight regarding the Services and replace any prior agreements on this subject. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may.
